Acceptable Use Policy

ClientVaultPro (clientvaultpro.ca) | Effective date: May 07, 2026 | Governed by Canadian Law

This Acceptable Use Policy (“AUP”) forms part of and is incorporated into the Terms of Service governing your use of ClientVaultPro. By subscribing to any ClientVaultPro plan, you agree to this AUP in its entirety.

1. What ClientVaultPro Is

ClientVaultPro is a service brand operated by Tachyon Business and Computer Solutions, a business registered in British Columbia. We provide automated, encrypted, immutable data backup to infrastructure physically located on Canadian soil and governed exclusively by Canadian law. The Service is a data backup service only.

ClientVaultPro is not a web hosting provider, cloud file synchronization service, or live production environment. We do not host websites, web applications, databases for live production use, email servers, or any other internet-facing services. If a client requests assistance with IT infrastructure, networking, device configuration, or related technical work outside the scope of the backup service, such engagement — if accepted — is governed by a separate written agreement and is not subject to this AUP.

2. Permitted Uses

You may use ClientVaultPro solely to back up data that you own or are lawfully authorized to back up, including:

  • Business documents, records, and files belonging to your organization.
  • Client data you hold in the ordinary course of your professional or business operations, provided you have obtained all necessary consents from those clients to store their data with a third-party provider.
  • Database exports, file system backups, and structured data created by or for your organization.
  • Personal data of your employees or contractors, with appropriate consent and in strict compliance with applicable Canadian privacy law (including PIPEDA and Quebec’s Law 25).

All use of the Service must comply with PIPEDA, Quebec’s Law 25, and all other applicable federal and provincial legislation.

3. Prohibited Data

You must not use ClientVaultPro to back up, store, or transmit any of the following:

  • Illegal content of any kind, including child sexual abuse material (CSAM) or material prohibited under Canadian law.
  • Malware, ransomware, spyware, viruses, or any malicious code, whether or not active.
  • Data you do not own and are not lawfully authorized to store, including data obtained through unauthorized access to third-party systems.
  • Data subject to export controls or sanctions that you are not licensed or authorized to handle.
  • Classified government information at any security classification level, unless separately authorized in writing by ClientVaultPro.
  • Data whose storage with a third party is prohibited by a court order, injunction, or legally binding confidentiality obligation.
  • Data that is intended to be used for the distribution of illegal content or the circumvention of security controls.

4. Prohibited Conduct

You must not:

  • Share your account credentials with any person not authorized under your plan.
  • Attempt to access the backup data of any other ClientVaultPro client.
  • Use the Service to probe, scan, or test the security of ClientVaultPro’s or our Infrastructure Provider’s infrastructure without prior written authorization.
  • Misrepresent the nature or volume of data being backed up to fit within an inappropriate plan tier.
  • Use the Service as a primary, live, or active data storage medium. The Service is designed for backup and disaster recovery. Using it as a working file system, for real-time file sharing, or as a production database is strictly prohibited and may result in data loss or service degradation.
  • Attempt to reverse-engineer, decompile, or interfere with any component of the ClientVaultPro platform or the backup software.
  • Use the Service to exfiltrate data from a compromised system or to hide evidence of a cyberattack.

5. Your Responsibility for Data Accuracy and Legality

You are solely responsible for ensuring that the data you back up through ClientVaultPro is data you are legally authorized to store, that your use complies with all applicable law, and that any personal information backed up is handled in accordance with your own privacy obligations to the individuals whose information it contains.

ClientVaultPro does not review, monitor, or audit the content of client backup data. Responsibility for the lawfulness of that content rests entirely with you. We rely on automated scanning for known malware signatures and illegal content hashes where legally permissible, but this does not constitute a guarantee of content safety.

6. Service Scope — What ClientVaultPro Does Not Provide

The following are outside the scope of the ClientVaultPro backup service and are not included in any plan unless separately contracted in writing:

  • Web hosting, domain hosting, or DNS management.
  • Email hosting or email archiving.
  • IT support, device management, or network configuration.
  • Software installation, troubleshooting, or maintenance.
  • Cybersecurity consulting, penetration testing, or incident response.
  • Managed IT services of any description.

If you request technical assistance beyond the backup service and ClientVaultPro agrees to provide it, the scope, fees, and terms of that engagement will be set out in a separate written agreement. No IT or technical work is implied, guaranteed, or included by virtue of your backup subscription.

7. Enforcement and Suspension

ClientVaultPro reserves the right to suspend or terminate your account immediately and without notice if we have reasonable grounds to believe you have violated this AUP.

  • In cases involving illegal content (such as CSAM), we will report the matter to the appropriate Canadian law enforcement authorities and may cooperate with their investigation.
  • If a violation involves the Infrastructure Provider’s systems, we will instruct the Provider to take necessary action to protect the integrity of the platform.
  • ClientVaultPro will not be liable to you for any losses arising from a suspension or termination resulting from your breach of this AUP.

8. Reporting a Violation

If you become aware of any use of the ClientVaultPro platform that violates this AUP, please contact us at legal@clientvaultpro.ca.

9. Changes to This Policy

ClientVaultPro may update this AUP from time to time. Material changes will be communicated by email to the address on your account. Continued use of the Service after notice of a change constitutes acceptance of the updated AUP.
