Amazon Web Services, Microsoft Azure, and Google Cloud all operate “Canadian regions.” The servers are physically in Canada. The problem is who owns those servers — and what law governs them.
The Cloud Act
In March 2018, the United States passed the Clarifying Lawful Overseas Use of Data Act — the Cloud Act. It grants American federal law enforcement the authority to compel US-incorporated companies to produce data stored anywhere in the world — including on servers physically located outside the United States.
Amazon Web Services, Inc. is incorporated in Delaware. Microsoft Corporation is incorporated in Washington State. Google LLC is incorporated in Delaware. All three are US companies under US law — regardless of where their servers sit. A Canadian business storing data with any of these providers is storing data that a US court order can reach. No Canadian government notification required. No Canadian court approval needed.
Does PIPEDA Protect Canadian Data?
PIPEDA cannot override a lawful US court order served to a US corporation. Canadian privacy law and American law enforcement authority operate in entirely separate legal frameworks.
What True Canadian Data Sovereignty Requires
- The company storing your data must be incorporated under Canadian law with no US parent corporation
- The servers must be physically located in Canada
- Data access must be governed exclusively by Canadian law

- Where is your parent company incorporated? If the United States, your data is Cloud Act-accessible.
